Lagos State Internal Revenue Service (LIRS) has issued a public notice (the Notice) informing all taxable individuals resident in Lagos State of the extension of the deadline for filing individual income tax returns for 2019, from 31 March 2020 to 31May 2020.
The extension of the filing deadline is in response to the extreme societal disruption caused by the novel Coronavirus (COVID-19 or the Pandemic) in Lagos State (the State). The Pandemic necessitated the Lagos State Government to issue a sit-at-home order to majority of its workforce and shut down economic activities in markets across the State.
According to Section 41 of the Personal Income Tax Act (PITA) (as amended), all taxable persons are required to file a return of claims and income from every source for the year preceding the year of assessment, with the relevant tax authority. The return is to be filed within 90 days from the commencement of every year of assessment (i.e., by 31 March of every year). However, with the issuance of the Notice, individual taxpayers resident in Lagos State during 2019 have an extended window of opportunity to collate all required documents for filing their individual income tax returns online via the dedicated e-tax portal at www.etax.lirs.net. We expect that other state tax authorities will take a cue from LIRS and issue similar filing extension to allow tax residents in the respective states meet their income tax filing obligations for 2019, in view of the Pandemic.
